How to dispute rent increase and rental deposit return

After the recent sample of a rent dispute letter we received at least a dozen requests to put together another two - on how you dispute rent increase and rental deposit refund, which are two rather large issues nowadays, with land- lords and ladies often abusing their powers. In these tough times with many former homeowners forced to rent, the demand for rental properties in certain areas emboldens the owners to overcharge the renters and often try squeezing them from their deposits.

Dear Sir/Madam/Property Manager

The contract we signed a year ago clearly states that you can not increase my monthly rent by more than $20 annually, and you must notify me in writing 30 days before the current lease expires. So the $50 monthly increase in my view equates with the contract rescission. Unless you notify me in writing within 5 business days that the unwarranted $50 increase is cancelled, I am prepared to take this matter to Small Claims Court, complain to Better Business Bureau and proceed further as needed.

To get you deposit back wasn't quite that difficult when I was still renting. That was then. These days rental deposit return is the major problem. Here is the letter

Dear Sir/Madam/Property Manager

I am writing you to demand the return of my rental deposit in full and promptly. Today I was informed that you are going to keep $750 deposit because of the alleged damage done to the apartment I occupied for 2 years. I find this unacceptable. Apartment I rented showed only normal wear and tear with no damage whosoever. i fulfilled all my contractual obligation with regards to shampooing the carpets, washing the windows, cleaning cabinets out completely and cleaning the bathroom. You can not claim anything for these services to be deducted from my deposit. Please be aware that I documented and photographed every damage that you allege was done by me, and can easily proof that all the damages claimed against me were present when I moved in. Please return my $750 rental deposit in full within 5 business days, or I will pursue this matter further.
