Wage garnishment in Texas is not constitutional

Q: I owe roughly $3,400 and the creditor threatens to garnish my pay. My legal department guy claims, Texas doesn't allow wage garnishment. Is this true? The creditor keeps on threatening.

A: You are in luck, as long as your paycheck comes from Texas, and not from an out-of-state location. There is no wage garnishment in Texas, as state constitution makes current wages exempt property. The only garnishable exceptions are child support, student loans, bank accounts, rents and royalties - to the best of my knowledge. Tell the creditor that the threats are very likely in violation of the Federal Debt Collection Act, as it has no legal authority for garnishment.
