Wage garnishment in Michigan

Q: What is the wage garnishment law in Michigan? I am making close to nothing and old credit card judgement came back hard.
A: Michigan wage garnishment writ expires 91 days after issuance, so a new one must be issued and served. If you make the minimum wage, no garnishment can happen. Otherwise the creditor can get up to 25% of disposable earnings per week.
If you have to pay, try to get Stay of Wage Garnishment. You have to go to court to obtain installment payment order, which bars wage garnishment. You must pay as required by such an order. That said, an order like this does not always prevent garnishment of bank accounts or income tax refunds. I would recommend to consult with attorney unless your credit card issuer has nothing to garnish in your case.
