Pay For Delete Letter, debt settlement letter

You normally send a Pay For Delete Letter when trying to settle with original creditors or collection agencies. Such a debt settlement letter is an important step of the agreement, where you are offering to pay off debt in full, or negotiating to settle it partially in return for the written promise from the creditor to delete every record of this debt from your credit reports. Typically when dealing with debt collectors, a Pay For Delete Letter is preceded by a Debt Validation Letter which demands a collection agency to verify that the debt in question is indeed yours. If the debt is validated, the next best option is to settle. Needless to say, you do not verify your very own debt with original creditors. With them, all you can do, save for declaring bankruptcy, is to negotiate a settlement from the start, to reach a somewhat amicable solution, satisfying you both.

Once you reach an agreement, which again must be in writing and pay, every record related to this debt must be removed from your credit reports. If the debt is with a collection agency, it will disappear from Derogatory Accounts section. If the debt with your original creditor, and you've been late on monthly payments, a creditor must report this account as Paid As Agreed if you negotiated to keep account open, or Closed By Consumer otherwise. I am offering to pay this debt in full (or settle this account for $__________) in return for your written agreement to remove all information related to this account from Equifax, Experian and TransUnion credit reports within 3 business days, and to never report the account again. If you agree to such terms, I will send you a certified payment of the amount stated, next business day after receiving the debt settlement agreement from you.

As the part of this agreement, you and {Collection Agency} will not discuss the terms with anyone but the original creditor of this account. Neither acknowledgment of debt nor information on settlement should be furnished to the credit reporting agencies.

If you and the original creditor agree to these terms, please send me a confirmation letter signed by your authorized representative. The letter should be subject to the laws of my state and treated as a contract.

As per the Fair Debt Collection Practices Act, I have the right to dispute this alleged debt. If I do not receive your response at my address listed above within the next 10 business days, I will withdraw the offer and request full verification of this debt.
